Banner Purchase Terms and Conditions

The following conditions are essential for the conclusion of a contract and are the part of an order. Any other conditions for the banner purchase will not be considered valid. Additional agreements or changes of individual clauses should be represented in writing.

§ 1 Prices

The price is considered to be the final at the moment of a contract conclusion. The rates do not include value added tax.

Subsequent changes in the ads, applied on the initiative of the client will be charged separately according to arrangement and price list.

§ 2 Conclusion

The contract comes into effect after the order is placed by the customer and it is confirmed by cottages-for-holidays.com that the order was received.

§ 3 Invoicing and Payment

The client will receive an invoice after the he confirms the banner design and receives the purchased banner. After the invoice will be paid, the banner will appear on-line, and client will receive the confirmation.

§ 4 Duration of the Contract

The contract between the customer and cottages-for-holidays.com is an agreed term. It is not automatically renewed and thus the customer can’t break it separately before the term comes to the end.

§ 5 Data Placement

The banner placing is performed according to the requirements, received with the order confirmation.

§ 6 Data Delivery

The client is responsible for giving the complete information, required for the advertisement.

§ 7 Rejection

Cottages-for-holidays.com reserves the right to reject advertising without giving the specific reasons.

§ 8 Defects

The customer should check the banner just after he/she receives it for approval. All the shortages must be discussed right away. In that case if the customer doesn’t make any remarks regarding defects – the banner will be considered valid.

§ 9 Liability

The client ensures that all the necessary rights to the advertising materials are supplied and that the contents of the advertisement are not against the law, legal or regulatory prohibitions or morality. The client provides cottages-for-holidays.com with any copyright, competition and other third-party claims in respect of which it commissioned advertising, and the cottages-for-holidays.com in the necessary legal defense costs.

Cottages-for-holidays.com is liable only for infliction of loss and for the violation of the clauses of the agreement.

§ 10 Applicable Law, Jurisdiction and Place of Performance

All the legal relations between the parties are controlled by the law of the Federal Republic of Germany. Jurisdiction and place of performance is Düsseldorf.
